Terms of Service

1. Acceptance of Terms

By accessing or using BodyOpia's gym management software ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Service Description

BodyOpia provides a comprehensive gym management platform designed specifically for South African fitness businesses, including:

  • Member management and registration
  • Workout planning and tracking
  • Nutrition guidance and meal planning
  • Payment processing and billing
  • Analytics and reporting tools
  • Mobile applications for members and gym owners

3. User Accounts and Responsibilities

3.1 Account Registration

To use BodyOpia, you must register for an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Permitted Use

You may use BodyOpia solely for lawful business purposes related to gym and fitness management. You agree not to:

  • Use the Service for any unlawful or fraudulent purposes
  • Attempt to gain unauthorized access to other accounts or systems
  • Upload or transmit viruses, malware, or other harmful content
  • Reverse engineer, decompile, or disassemble the Service
  • Share your account credentials with unauthorized parties

4. Subscription and Billing

4.1 Free Trial

BodyOpia offers a 14-day free trial for new accounts. No payment information is required to start your trial. The trial automatically expires unless you choose to subscribe.

4.2 Paid Subscriptions

After your trial period, you may choose from our available subscription plans. All fees are in South African Rand (ZAR) and are billed monthly or annually based on your selected plan.

4.3 Payment Terms

Payment is due in advance for each billing cycle. We accept major South African payment methods including EFT, credit cards, SnapScan, and Zapper. Failed payments may result in service suspension.

4.4 Automatic Renewals

Important Notice About Automatic Renewals

Your subscription will automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date.

Renewal Notifications: We will send you an email reminder at least 20 business days before your subscription automatically renews, as required by the South African Consumer Protection Act. This email will include:

  • Your upcoming renewal date
  • The amount that will be charged
  • Instructions on how to cancel if you choose not to renew

How to Cancel Automatic Renewal: You may cancel your subscription at any time through your account settings or by contacting us at admin@bodyopia.com. Cancellation takes effect at the end of your current billing cycle.

4.5 Refunds and Consumer Protection Rights

Voluntary Money-Back Guarantee: We offer a 30-day money-back guarantee for annual subscriptions as a voluntary goodwill gesture.

Your Rights Under South African Consumer Protection Act

5-Business-Day Cooling-Off Period: As a consumer purchasing services through distance selling (online), you have the unconditional right to cancel your subscription within five (5) business days from the date of purchase or receipt of transaction confirmation, without reason or penalty.

To Exercise Your Cooling-Off Rights:

  1. Send written notice to admin@bodyopia.com within 5 business days
  2. Include your name, contact details, transaction date, and statement of cancellation
  3. We will process your full refund within 30 business days

Important: These statutory consumer rights under the Consumer Protection Act apply regardless of any other refund policies stated herein. For full details, see our Money-Back Policy.

5. Data Protection and Privacy

BodyOpia is committed to protecting your data and complies with South African data protection laws, including the Protection of Personal Information Act (POPIA). Our data practices are detailed in our Privacy Policy.

5.1 Data Ownership

You retain ownership of all data you input into BodyOpia. We provide data export tools and will not hold your data hostage if you cancel your subscription.

5.2 Data Security

We implement industry-standard security measures to protect your data, including SSL encryption, regular backups, and secure data centers.

6. Service Availability and Support

6.1 Uptime Guarantee

We strive to maintain 99.9% uptime for our Service. Scheduled maintenance will be announced in advance when possible.

6.2 Customer Support

7. Intellectual Property

BodyOpia and all related trademarks, copyrights, and intellectual property are owned by BodyOpia (Pty) Ltd. You are granted a limited, non-exclusive license to use the Service during your subscription period.

8. Limitation of Liability

To the maximum extent permitted by South African law, BodyOpia shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

9. Termination and Cancellation

9.1 Termination by You

You may cancel your subscription at any time through your account settings or by contacting us at admin@bodyopia.com.

Cancellation Process:

  • Standard Cancellation: Takes effect at the end of your current billing cycle. You will continue to have access to the Service until the end of the paid period.
  • CPA Cooling-Off Period Cancellation: If you cancel within 5 business days of purchase (as per Section 4.5 above), your cancellation is immediate and you will receive a full refund within 30 business days.

What Happens After Cancellation:

  • You retain access to your data for 30 days after cancellation
  • You can export all your data using our data export tools
  • After 30 days, your data will be permanently deleted from our active systems
  • Backup copies may be retained for up to 90 days for disaster recovery purposes

9.2 Termination by BodyOpia

We may terminate or suspend your account for violations of these Terms or for non-payment. Before termination for non-payment, we will:

  • Send you written notice via email
  • Provide at least 20 business days to remedy the payment issue
  • Offer you the opportunity to export your data before final termination

10. South African Consumer Protection Act Compliance

Your Consumer Rights

BodyOpia (Pty) Ltd is committed to full compliance with the South African Consumer Protection Act 68 of 2008 ("CPA"). As a consumer, you are entitled to the following rights:

10.1 Right to Information

You have the right to receive information about our services in plain and understandable language, including:

  • Full pricing information in South African Rand (ZAR)
  • Terms and conditions of service delivery
  • Cancellation and refund policies
  • Automatic renewal terms and notification procedures
10.2 Right to Fair, Reasonable and Just Terms

These Terms have been drafted to be fair, reasonable, and just as required by the CPA. We do not include unfair, unreasonable, or unjust contract terms.

10.3 Right to Fair Value, Good Quality and Safety

We are committed to providing services that are:

  • Of good quality and fit for purpose
  • Safe and secure for your data
  • Reasonably priced and providing fair value
10.4 Right to Fair and Honest Dealing

We commit to:

  • Transparent and honest advertising
  • No false, misleading or deceptive representations
  • Fair business practices in all our dealings
  • Respecting your right to privacy (see our Privacy Policy)
10.5 Dispute Resolution

If you have a complaint or dispute:

  1. Contact us first at admin@bodyopia.com - we will attempt to resolve it within 15 business days
  2. If unresolved, you may refer the matter to an alternative dispute resolution agent
  3. You may also refer complaints to the National Consumer Commission

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa, including but not limited to:

  • Consumer Protection Act 68 of 2008
  • Protection of Personal Information Act 4 of 2013 (POPIA)
  • Electronic Communications and Transactions Act 25 of 2002

Any disputes will be resolved in accordance with South African law and jurisdiction, with courts in Cape Town, South Africa having non-exclusive jurisdiction.

12. Changes to Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices.

Notice of Changes:

  • We will notify you at least 20 business days before any material changes take effect
  • Notice will be sent via email to your registered email address
  • Notice will also be displayed prominently in the Service
  • The updated date at the top of this document will be changed

Your Rights: If you do not agree with the changes, you may cancel your subscription as per Section 9.1 above. Continued use after the effective date constitutes acceptance of the new Terms.
